From the latest Prop 8 ruling:
Because California has no interest in discriminating against gay men and lesbians, and because Proposition 8 prevents California from fulfilling its constitutional obligation to provide marriages on an equal basis,the court concludes that Proposition 8 is unconstitutional.
However, Obama's DOJ is defending Prop 8 and may repeat their previous argument: that a gay man has equal right to get a marriage license to marry a woman, so gays are NOT being treated un-equally, so there!

That said, I'm sad that the DOJ is defending DOMA. I just do not see any rational arguments that don't sum up to "our religious beliefs are better and more important than everyone else's."
